There are no hidden fees; if you are searching for them in small print, this is your notice that there are none.
Use of Ahosting’s Service constitutes acceptance and agreement to Ahosting’s Acceptable Use Policy (AUP) as well as Ahosting’s Terms of Service (TOS). Within this TOS, AUP, Service Legal Agreement (SLA) and Resource Abuse Policy (RAP), the words “us”, “we”, “our” and “ours” refer to Ahosting. The words “you”, “your”, “they” and “them” refer to the client/customer of Ahosting.
Acceptance of Contractual Agreement
- Client agrees that by placing an order either through electronic ordering (web order form) or by submitting a written contract, and upon Ahosting’s receipt of such order, they agree to our TOS, AUP, and SLA. No modifications of the contract by the customer are permitted.
- Ahosting will provide, and Customer will purchase and pay for, the Services and fees specified in the Order for the applicable Service Description. Customer acknowledges that the service and fees have been communicated and that they are aware of all applicable charges under the contract, AUP, SLA, and TOS. Customer also understands that promotional offers are only valid if specifically included in contractual terms.
- If Customer’s bandwidth usage in any given month exceeds the amount allotted in their contract, Customer must pay Ahosting additional fees as specified in the Service Description within three (3) days of the invoice date. Failure to pay bandwidth overage fees within this period will result in suspension of the server and services.
Prohibited Content/Services
- Warez
- IRC
- Adult content (only permitted on specific web & reseller packages)
- Child pornography
- Copyrighted media (including but not limited to video, music, TV, radio)
- Hacking tools/material
- Proxy services/pages
- Torrents
- Peer-to-Peer services
- Anything harmful to Ahosting, its servers, or others (physically or mentally)
- Sites with high HTTPD, MySQL, bulk email sending, or any process that overloads servers (web & reseller only)
- Forums using heavy databases and extremely large memberships (web & reseller only)
*Ahosting reserves the right to suspend or remove accounts containing any prohibited material without prior notice.
Threatening, abusive, or offensive language directed at Ahosting staff in live chat or support tickets is strictly prohibited.
Network Uptime
Ahosting guarantees 99.9% network uptime each calendar month. We take responsibility for availability within our network but cannot be held liable for upstream provider issues. Uptime guarantees apply only to total outages resulting in 100% packet loss within Ahosting’s network.
Definitions
Network Outage / Unscheduled Downtime: Unplanned interruptions causing 100% packet loss due to issues within Ahosting’s network, confirmed by Ahosting.
Scheduled Downtime: Planned interruptions for upgrades or maintenance, with at least 12–24 hours prior notice by email.
SLA Network Violation Credit
Exclusions from SLA credits include: scheduled downtime, upstream provider issues, client misconfiguration, third-party software, client abuse, resource overutilization, hacked servers, attacks, exploits, or hardware failure. We will act promptly to remove offending users causing disruptions.
Payment
Service activation is contingent upon receipt of payment. Subsequent payments are due monthly on the recurring billing date unless consolidated billing has been arranged.
Payments and Fees
- Payment is due on the recurring billing date.
- Declined credit cards incur a $10 fee.
- Accounts 10 days past due will be suspended.
- Service reconnection after suspension requires a $200 fee.
- Late fees of $9.99 apply after the due date.
- Accounts in collections are subject to a $50–$150 processing/collection fee.
Server Payment Issues
The order date is considered the Server Payment Date (SPD). Payments must be made on SPD each month. If payment fails, notification will be sent by email, and you must respond within 48 hours. If unpaid after this period, Ahosting reserves the right to suspend and then terminate the server. Restoration after termination requires a $50 service fee. Customers must ensure sufficient funds are available on their payment date. Add-ons (RAM, HDD, uplinks, etc.) must be paid at order time; otherwise, Ahosting may disable them.
Delinquent Accounts
Ahosting may suspend or terminate services for failure to pay. Termination does not release the customer from liability for accrued charges or collection fees.
Delinquent Reseller Accounts
Resellers have 48 hours after suspension to pay overdue balances. If not resolved, reseller clients may purchase services directly from Ahosting. The delinquent balance must be paid in full before service restoration. Resellers remain solely responsible for timely payments.
Backups (Shared Servers)
Ahosting provides daily backups for shared servers. However, clients are fully responsible for their files and databases. Ahosting is not liable for data loss caused by hardware failure, OS reinstallation, or other unforeseen issues.
Reseller Package Upgrades
Reseller packages may be upgraded anytime. If upgraded within 2 weeks of the last payment, only the price difference is due and the new package begins at the next billing cycle. After 2 weeks, the full new package price must be paid immediately, and the old subscription will be cancelled.
Account Cancellation
All cancellations must be requested in writing by email to billing [at] ahosting [dot] net at least 15 but not more than 30 days prior to cancellation. Include your domain name and the cardholder’s last name. Dedicated Servers: first month payments (including setup fees) are non-refundable.
Refunds and Disputes
All payments are non-refundable, including setup and monthly fees. Billing disputes must be reported within 30 days. Valid disputes (as determined by Ahosting) resulting in chargebacks will lead to immediate service suspension. Reconnection fees apply.
30-Day Money Back Guarantee
Wordpress Hosting, Web Hosting, WooCommerce Hosting, Reseller Hosting and VPS Hosting plans include a 30-day money-back guarantee. If you are dissatisfied, we will refund your payment (excluding setup fees) upon request. Dedicated Servers are excluded from this guarantee.
Bandwidth Overage (Dedicated Servers)
Servers include monthly bandwidth allocations. Exceeding the limit will incur $0.30 per GB charges, billed in arrears. Customers and resellers are responsible for monitoring usage and paying overage fees.
Dedicated Server Restores
Ahosting is not responsible for restoring customer data. Clients must maintain their own backups. Ahosting is not liable for data loss under any circumstance.
Hardware Replacement
Hardware replacements occur within 1–8 hours of issue confirmation. For each additional 8 hours, a 5% monthly fee credit applies (up to 100%). Pre-built systems and pre-installed drives are maintained for quick recovery. SLA violation credit requests must be submitted within 10 days to sales [at] ahosting [dot] net. SLA reviews are conducted Monday–Friday, 9 AM–5 PM EST.
*Hardware SLA credits do not cover network violations.
